These Terms of Service (“Terms”) govern your access to and use of solnox.one (the “Site”) and any purchase you make from it. The Site is owned and operated by SOLNOX, a sole proprietorship having its principal place of business at Bhagwan Oil Mill, Market Yard, Jintur, Parbhani District, Maharashtra 431509, India (“SOLNOX”, “we”, “us”, “our”).
By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site. These Terms constitute an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature.
1. Definitions
- “You” / “Customer” means any person who accesses the Site or places an order.
- “Products” means the goods listed for sale on the Site.
- “Order” means your request to purchase Products, submitted through checkout.
- “Policies” means our Privacy Policy, Shipping & Delivery Policy, and Refund, Return & Cancellation Policy, each incorporated into these Terms by reference.
2. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 in order to place an order. If you are a minor, you may use the Site only under the supervision of a parent or legal guardian, who accepts these Terms on your behalf and remains responsible for the order.
By placing an order you confirm that the information you provide is true, accurate, current and complete.
3. Your Account
You may be required to create an account to place or track orders. You are responsible for keeping your login credentials confidential and for all activity carried out under your account. Please notify us immediately at Contact@solnox.in if you suspect unauthorised use. We may suspend or terminate any account we reasonably believe has been used fraudulently or in breach of these Terms.
4. Products, Descriptions and Availability
We take reasonable care to describe our Products accurately. However:
- Product images are illustrative. Actual colour, packaging, batch labelling and finish may vary owing to photography, screen calibration and supplier changes.
- Weights, dimensions and pack quantities are as stated on the product page and in the statutory declarations printed on the package under the Legal Metrology (Packaged Commodities) Rules, 2011. Where the two differ, the declaration printed on the package prevails.
- All Products are subject to availability. The listing of a Product on the Site is an invitation to offer and not an offer to sell.
5. Pricing
- All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless expressly stated otherwise at checkout.
- Shipping charges are additional and are shown to you at checkout before payment.
- For international orders, customs duties, import taxes and clearance fees are not included and are payable by you. Please see our Shipping & Delivery Policy.
- We may change prices, offers and promotions at any time without prior notice. The price applicable to your order is the price displayed at the time your order is confirmed.
Pricing errors. Despite our best efforts, a Product may occasionally be listed at an incorrect price due to a typographical, system or supplier error. Where the correct price is higher than the listed price, we will either contact you for instructions before dispatch or cancel the order and notify you. In either case you will receive a full refund of any amount already paid.
6. Orders and Acceptance
When you place an order you make an offer to purchase. Our order confirmation email is an acknowledgement of receipt only. A binding contract is formed only when we dispatch the Products and send you a dispatch or shipping confirmation.
We reserve the right to refuse, limit or cancel any order, in whole or in part, including where:
- the Product is out of stock or has been discontinued;
- there is an error in the price or description;
- we suspect fraud, misuse of a discount code, or bulk buying for commercial resale;
- the delivery address is outside our serviceable area, or is incomplete or unverifiable;
- payment authorisation fails or is subsequently reversed.
If we cancel a paid order, we will refund the full amount in accordance with our Refund, Return & Cancellation Policy.
7. Payment
We accept the payment methods displayed at checkout. Payments are processed by third-party payment gateways that are PCI-DSS compliant. We do not collect, view or store your full card number, CVV, UPI PIN or net-banking credentials.
You represent that any payment instrument you use is lawfully yours and that sufficient funds or credit are available. If a payment is reversed, charged back or fails after dispatch, we may recover the amount due and withhold further service until it is settled.
8. Shipping, Delivery and Returns
Dispatch timelines, delivery estimates, shipping charges and international duties are set out in our Shipping & Delivery Policy. Cancellations, returns, replacements and refunds are governed by our Refund, Return & Cancellation Policy. Please read both before ordering; they form part of these Terms.
Risk of loss and title in the Products pass to you upon delivery at the address you provided.
9. Acceptable Use
You agree not to:
- use the Site for any unlawful, fraudulent or harmful purpose, or in violation of any applicable law;
- resell, scrape, data-mine, frame, mirror or reverse-engineer any part of the Site;
- introduce viruses, malware or any code designed to disrupt the Site or gain unauthorised access to its systems;
- circumvent security features, rate limits or access restrictions;
- impersonate any person or misrepresent your affiliation with any person or entity;
- post content that is defamatory, obscene, infringing, hateful or otherwise unlawful under Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
10. Intellectual Property
All content on the Site — including the SOLNOX name and logo, text, graphics, layout, product photography and software — is owned by or licensed to SOLNOX and is protected by Indian and international copyright and trademark law. You may view and print content for your own personal, non-commercial use. Any other use, including reproduction, modification, distribution or commercial exploitation, requires our prior written permission.
Third-party brand names and trademarks appearing on the Site belong to their respective owners and are used only to identify the Products.
11. Reviews, Feedback and User Content
If you submit reviews, photographs, comments or suggestions (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, perpetual and transferable licence to use, reproduce, publish, adapt and display that content in connection with our business, without any obligation to compensate you.
You confirm that your User Content is your own, is accurate, and does not infringe the rights of any third party. We may edit, decline to publish, or remove any User Content at our discretion, and are under no obligation to monitor it.
12. Third-Party Links and Services
The Site may link to or embed third-party websites, applications and services (including payment gateways, courier tracking and analytics tools). We do not control and are not responsible for their content, products, privacy practices or terms. Your dealings with third parties are solely between you and them.
13. Disclaimer of Warranties
The Site and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free.
Health and personal care products. Statements on the Site regarding herbal, wellness, personal care and similar Products are for general information only and have not been evaluated by any drug regulatory authority. They are not intended to diagnose, treat, cure or prevent any disease and are not a substitute for professional medical advice. Please read our Disclaimer before use.
Nothing in these Terms excludes or limits any right or remedy available to you as a consumer under the Consumer Protection Act, 2019 or any other law that cannot lawfully be excluded.
14. Limitation of Liability
To the maximum extent permitted by applicable law, SOLNOX and its proprietor, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of the Site or any Product.
Our total aggregate liability in connection with any order shall not exceed the total amount actually paid by you for that order.
15. Indemnity
You agree to indemnify and hold harmless SOLNOX and its proprietor, employees and agents against any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.
16. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including acts of God, flood, fire, earthquake, epidemic or pandemic, war, civil unrest, strikes, courier or logistics disruption, government action or restriction, power failure, or failure of telecommunications or internet networks.
17. Suspension and Termination
We may suspend or terminate your access to the Site at any time, without notice, if you breach these Terms or if we reasonably suspect fraudulent or abusive activity. Sections 10 to 15, 18 and 19 survive termination.
18. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the grievance redressal process set out in Section 19, the courts at Parbhani, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. Nothing in this section prevents a consumer from approaching the Consumer Commission having jurisdiction under the Consumer Protection Act, 2019.
19. General
- Entire agreement. These Terms, together with our Policies, form the entire agreement between you and us in relation to the Site.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition or sale of business.
- Changes. We may revise these Terms at any time by posting an updated version on this page with a new “Last updated” date. Continued use of the Site after such changes constitutes acceptance.
